With this in the background, the Superior Court of Justice and the Government of Ontario has brought about a number of court reforms.  Since January 1, 2010, the limit for Ontario Small Claims Court has been increased to $25,000.  This will allow civil disputes involving small sums of money to be resolved more quickly and at a more reasonable and affordable price.

General Procedures Prior to the Commencement of a Legal Proceeding:

1.  First screening conference, over the phone or via Skype.  The prospective client will explain his/her problem in general.  Possibility for representation may or may not be considered.

2.  A second conference will be held with the potential client, face to face, to gather facts, background information, to explain the problem.

3.  Once the case is retained, the client will explain his issue in detail and hand over all relevant documents in his possession.

4.  The client will be suggested different options for Ontario Small Claims Court which will suit their needs.

 

Beginning of Legal Proceedings for Ontario Small Claims Court:

1.  Open the new file.  Peruse and draft documents;

2.  Prepare Case  and have condensed Summary;

3.  Draft correspondence and pleadings;

4.  File pleadings with appropriate Ontario Small Claims Court; and

5.  Serve documents on other parties.

 

Preparation for Case Conference:

1.  Study the whole file;

2.  Conduct legal  and Internet research;

3.  Ask Client if s/he wants to settle this matter, on what conditions;

3.  Document filing in court;

4.  Preparation of court submissions;

5.  Attend Case Conference.

 

Preparation for Trial:

1.  Interview and prepare Witness for Trial;

2.  Preparation of court submissions;

3.  Attend  Trial at Ontario Small Claims Court.

 

Civil Enforcement Proceedings (After Judgment, if required):

1.  Filing documents with the Court;

2.  Serve documents on the other parties; and

3.  Attend  Examination Hearing.


The above steps demonstrate the usual structure of the litigation process. Some items may or may not happen.  There also could be various additional steps such as Motions, and/or court hearings held to determine specific legal issues, or to grant a specific award at any stage of the litigation, even after a Judgment.
